Bilaterale Investitionsschutzverträge (BITs) sind völkerrechtliche Verträge zum Schutz von Auslandsinvestoren und verfügen regelmäßig über sog. Fortgeltungsklauseln (auch survival bzw. sunset clauses), die den Investorenschutz in zeitlicher Hinsicht verfestigen, indem sie einseitige Kündigungen erst nach Abwarten einer 10-, 15- oder sogar 20-jährigen Frist wirksam werden lassen. Allerdings lassen Fortgeltungsklauseln offen, ob sie auch den Fall einvernehmlicher Kündigungen erfassen. Diese Frage ist Kern der Untersuchung und umfasst grundsätzliche Probleme des aktuellen Völkervertragsrechts: Wie gestaltet sich das Verhältnis zwischen der Freiheit der Vertragsstaaten und dem durch einen Vertrag geschaffenen Individualschutz? Kommt Investoren mittels der Fortgeltungsklauseln ein besonders gefestigter Individualschutz zu? Welche alternativen Wege stehen Vertragsstaaten eines BIT zur Verfügung, um einen BIT aufzuheben oder abzuändern?
